For research and training or for clinical uses of SASB Intrex questionnaires, manuals and software

1. Users understand and agree that The University of Utah and their respective officers, employees and agents, including the programmers, will under no circumstances be liable for any damages, consequential or inconsequential, greater than the purchase price of the SASB Intrex materials. Users shall indemnify, hold harmless and defend the programmers, the University of Utah, and their respective officers, employees and agents, against any and all claims, suits, losses, damage, costs, fees and expenses (including attorneys’ fees) resulting from or arising out of any uses of these questionnaires, manuals or software.

2. Users understand and agree that neither the University of Utah, its agents or representatives, including the programmers will provide consultation about how to use the SASB / Intrex software. The University of Utah, its agents or representative, including the programmers extend no warranties of any kind , either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or program conformity with whatever user manuals or other literature may be issued from time to time.

3. Users understand and agree that if any output from the SASB/ Intrex software is shown directly to respondents, the entire procedure is the responsibility of the users. Users attest they can and will comply with applicable ethical and professional standards in using the SASB/Intrex materials and that they have adequate malpractice or other appropriate coverage for any of their uses of the SASB / Intrex materials.

4. Users understand and agree that Administrations of the SASB Intrex software will be only on a single computer. Users will not install the program on a network, the Web, or any other medium. Users recognize and accept that the software and questionnaires are protected by copyright. Users do not have the right to alter or make further developments of the questionnaires or the software. The programs will not be reverse engineered or altered and the questionnaires will not be changed. Two copies of the programs and results are permitted for purposes of archiving and backup. No other purposes for copying are allowed

5. Data for individuals will be protected according to professional and ethical standards.

6. Users understand and agree to prepay royalties according to the current research or clinical schedule of fees, which may be revised annually.

7. Users understand and agree that they are qualified research or clinical users of these materials. If the uses are for research and the results are to be shown to respondents, there will be proper review and approval of the procedure by an Institutional Review Board. If the uses are for clinical services and the results are to be shown to respondents, users agree to document their clinical qualifications on the accompanying Qualified Users Form.
